With EXPERT INFO, we bring you closer to important current topics. <\/p>\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-e9237039847deac531368f5205f06c9b\" style=\"color:#004d82\">Protection against unjustified debt collection &#8211; new rule from 2026<\/h2>\n\n<p class=\"wp-block-paragraph\">In Switzerland, debt enforcement proceedings can be initiated without the claim having to be proven beforehand. An entry is made in the debt collection register as soon as the <strong>payment order<\/strong> is issued, which is visible to third parties (e.g. banks, landlords or business partners). This can have considerable disadvantages for those affected.    <\/p>\n\n<p class=\"wp-block-paragraph\">To prevent abuse, it is possible to <strong>have unjustified debt enforcement against third parties suppressed<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">New since <strong>January 1, 2026<\/strong>:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>An application for <strong>non-disclosure<\/strong> can be made at the earliest <strong>3 months after service of the payment order<\/strong>.<\/li>\n\n\n\n<li>The deadline for this application has been <strong>extended<\/strong> from <strong>1 year to 5 years<\/strong>.<\/li>\n\n\n\n<li>The creditor must prove that the claim has been pursued.<\/li>\n\n\n\n<li>If this proof is not provided, the entry is hidden from third parties.  <\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">However, non-disclosure is excluded if the claim has been acknowledged or paid (e.g. without a legal proposal, full payment or acknowledgement of debt).<\/p>\n\n<p class=\"wp-block-paragraph\">The new rule significantly strengthens legal protection against abusive debt collection.<\/p><p class=\"p1\" style=\"white-space: normal;\"><\/p>\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-d9008a496011abdcc42090e4b0f2a301\" style=\"color:#004d82\">Abolition of imputed rental value &#8211; reform of residential property taxation<\/h2>\n\n<p class=\"wp-block-paragraph\">The imputed rental value is a notional income for owner-occupied residential property that previously had to be taxed. At the same time, owners were able to deduct <strong>maintenance costs, energy-related investments and debt interest<\/strong> for tax purposes.   <\/p>\n\n<p class=\"wp-block-paragraph\">The <strong>referendum on September 28, 2025<\/strong> decided to abolish this system.<\/p>\n\n<p class=\"wp-block-paragraph\">The most important changes:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>The <strong>imputed rental value does not<\/strong> apply to owner-occupied properties.<\/li>\n\n\n\n<li><strong>Maintenance costs<\/strong> for such properties can <strong>no longer be deducted<\/strong> in future.<\/li>\n\n\n\n<li><strong>Energy-related investments<\/strong> are also no longer deductible for direct federal tax purposes (cantonal exceptions possible).<\/li>\n\n\n\n<li>The <strong>deduction of debt interest is severely restricted<\/strong>.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">An exception applies to <strong>first-time buyers<\/strong>:<\/p>\n\n<p class=\"wp-block-paragraph\">In the first <strong>10 years after acquisition<\/strong>, debt interest can be deducted to a limited extent.<\/p>\n\n<p class=\"wp-block-paragraph\">The reform will come into force <strong>on January 1, 2028 at the earliest<\/strong>. Until then, the previous rules will continue to apply. <\/p>\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-8dacc8a977f78bbe17c94475c1946b27\" style=\"color:#004d82\"><strong>AHV reform &#8211; dividends instead of wages<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">Employees with an interest in their own company can receive income as a <strong>salary or dividend<\/strong>. These two forms are treated differently for tax and social security purposes.   <\/p>\n\n<p class=\"wp-block-paragraph\">Dividends:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>do not count as earned income<\/strong><\/li>\n\n\n\n<li>are <strong>not<\/strong> subject <strong>to AHV contributions<\/strong><\/li>\n\n\n\n<li>are <strong>only partially taxed<\/strong> for shareholdings of <strong>10%<\/strong> or more<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">This creates an incentive to pay out <strong>more dividends and fewer wages<\/strong> in order to save on taxes and social security contributions.<\/p>\n\n<p class=\"wp-block-paragraph\">Today, compensation funds can intervene if:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Dividends are <strong>obviously excessive<\/strong> <\/li>\n\n\n\n<li>at the same time a <strong>wage that is not in line with the market<\/strong>.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">A dividend is often considered excessive if it amounts to <strong>10% or more of the tax value of the shareholding<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">As part of a future <strong>AHV revision<\/strong>, it will be examined whether excessive dividends should automatically become partially <strong>subject to AHV contributions<\/strong> in future.<\/p>\n\n<h1 class=\"wp-block-heading has-text-color has-link-color wp-elements-66a8a36da96c95f156e7ff4e655e4c56\" style=\"color:#004d82\"><strong>Child tax deduction &#8211; entitlement and apportionment<\/strong><\/h1>\n\n<p class=\"wp-block-paragraph\">The child deduction is a <strong>social deduction<\/strong> for direct federal tax and cantonal taxes. It takes into account the additional costs for children.   <\/p>\n\n<p class=\"wp-block-paragraph\">Principles:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Entitlement exists for <strong>underage children<\/strong> or children in education.<\/li>\n\n\n\n<li>The decisive factor is <strong>who actually bears the maintenance costs<\/strong>, not just the legal maintenance obligation.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">For separated parents:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>If one parent bears the majority of the costs \u2192 <strong>full child deduction<\/strong><\/li>\n\n\n\n<li>In the case of joint care \u2192 <strong>split equally<\/strong><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The following applies to underage children with maintenance payments:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Recipient of maintenance payments receives <strong>the child deduction<\/strong><\/li>\n\n\n\n<li>Payer can <strong>deduct maintenance payments for tax purposes<\/strong><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">For <strong>direct federal tax 2025<\/strong>, the child deduction amounts to <strong>CHF 6,800 per child<\/strong>.
